These Terms and Conditions (“Terms”) govern your use of the Travel Elite Concierge Services (“Travel Elite,” “we,” “us,” “our”) website and services. By accessing our site or engaging our services, you agree to these Terms.

1) Services

• Scope: We arrange and facilitate travel, lifestyle, and concierge services through our vetted network of third‑party providers (“Partners”).
• Discretion: Services are delivered with confidentiality and on a best‑efforts basis, subject to availability and Partner terms.

2) Client Responsibilities

• Accurate Information: You agree to provide complete and accurate details (e.g., names, IDs, preferences, payment authorization) required to fulfill requests.
• Compliance: You are responsible for complying with laws, visa/entry requirements, health regulations, and property rules.
• Conduct: You agree to respectful conduct toward staff, Partners, and property; you are liable for any damages or penalties caused by you or your party.

3) Quotes, Fees, and Payments

• Quotes: Estimates are based on availability at the time of quoting and may change until confirmed and paid.
• Fees: Our service/concierge fees are separate from Partner costs (e.g., airfare, hotels, charters) and are non‑refundable once work begins unless required by law.
• Deposits: Certain requests require deposits or full prepayment to secure availability.
• Currency: Prices are typically presented in USD unless otherwise noted.
• Payment Methods: We accept payments via secure, third‑party processors. You authorize us to charge agreed amounts for confirmed services.
• Taxes/Charges: You are responsible for all applicable taxes, governmental fees, resort fees, service charges, and surcharges.

4) Cancellations, Changes, and Refunds

• Partner Policies: Cancellations, changes, and refunds are subject to the applicable Partner’s terms, which may include non‑refundable deposits, date restrictions, and penalties.
• Our Fees: Travel Elite service/concierge fees are non‑refundable once services have commenced, except where prohibited by law.
• Client‑Initiated Changes: We will assist with modifications; any additional costs, penalties, or fare differences are your responsibility.
• Force Majeure: We are not liable for failures or delays due to events beyond our reasonable control (e.g., weather, strikes, government actions, pandemics, technical outages).

5) Special Requests and Preferences

We will convey and coordinate preferences (e.g., seating, bedding, dietary, accessibility). Fulfillment is not guaranteed and depends on availability and Partner policies.

6) Passports, Visas, Health, and Insurance

• Documentation: You are responsible for valid passports, visas, permits, vaccination, and health requirements.
• Insurance: We strongly recommend comprehensive travel and event insurance covering medical, cancellation, baggage, liability, and supplier default.

7) Third‑Party Providers

• Relationship: Travel Elite coordinates services provided by independent Partners. We do not control their operations and are not responsible for their acts, omissions, or policies.
• Terms: Your use of Partner services is also governed by the Partner’s terms and conditions.

8) Liability and Disclaimers

• No Warranty: Services are provided “as available.” We disclaim warranties to the fullest extent permitted by law.
• Limitation of Liability: To the maximum extent permitted by law, our aggregate liability arising out of or related to the services or these Terms shall not exceed the total service fees you paid to Travel Elite for the specific engagement giving rise to the claim.
• Exclusion: We are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost data, or loss of enjoyment.
• Indemnity: You agree to indemnify and hold harmless Travel Elite and its officers, employees, and agents from claims, damages, losses, and expenses arising from your breach of these Terms or misuse of the services.

9) Privacy

Your privacy is important to us. Our collection and use of personal information is described in our Privacy Policy. By using our services, you consent to such processing.

10) Intellectual Property

• Ownership: The website, content, branding, text, images, and materials are owned by or licensed to Travel Elite and protected by law.
• License: You may use the site for personal, non‑commercial purposes. No content may be copied, modified, distributed, or exploited without prior written consent.

11) Prohibited Uses

You agree not to:

• Misuse the site or services (including introducing malware, scraping, or reverse engineering).
• Make false or fraudulent requests.
• Infringe intellectual property, privacy, or other rights.
• Interfere with security features or attempt unauthorized access.

12) Account and Security (if applicable)

• Responsibility: You are responsible for all activities under your account.

13) Communications

14) Governing Law and Dispute Resolution

• Governing Law: These Terms are governed by the laws of The Bahamas, without regard to conflict of law principles.
• Disputes: The parties will first attempt to resolve disputes amicably. If unresolved, disputes shall be submitted to confidential arbitration in The Bahamas under applicable rules, with proceedings in English. Each party bears its own costs unless the arbitrator decides otherwise.
• Injunctive Relief: Either party may seek injunctive or equitable relief in court to protect intellectual property or confidential information.

15) Changes to the Terms

We may update these Terms from time to time. The Effective Date above indicates the latest version. Continued use of the site or services after changes constitutes acceptance.

16) Severability

If any provision is found unenforceable, the remaining provisions remain in full force and effect.

17) Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights consistent with law.

18) Entire Agreement

These Terms, together with any confirmed proposals, invoices, and the Privacy Policy, constitute the entire agreement between you and Travel Elite regarding the services.
